These terms govern access to and use of SMI Pilot by the professional customers of DJIB-TECHNO SARL.
1Purpose
These terms of use define the rights and obligations that apply to access to and use of the SMI Pilot platform. Use of the service constitutes acceptance of these terms.
2Service description
SMI Pilot is a platform designed to help manage an Integrated Management System, including the ISO/IEC 27001, ISO 9001, ISO 22301 and ISO 14001 standards. It helps organise assessments, controls, evidence, action plans and reports.
SMI Pilot is an assistance tool. It does not perform certification and does not replace the expertise of a qualified auditor or the user’s own decisions.
3Account creation and security
Users must provide accurate and current information when creating an account. They are responsible for keeping their credentials confidential and for activity carried out through their account.
Any unauthorised use or suspected compromise must be reported promptly to DJIB-TECHNO SARL. The publisher may suspend access where a security risk exists.
4Plans and subscription term
The applicable features, limits, prices and billing periods are those shown at the time of purchase. Unless stated otherwise, a subscription renews for an equivalent term until cancelled.
The sale is operated by Paddle.com Market Ltd, acting as reseller and Merchant of Record. Paddle’s terms of sale apply to the transaction, including billing, payment and taxes.
5User obligations
Users agree to use the service in accordance with applicable law, third-party rights and its professional purpose. Attempts to gain unauthorised access, disrupt the service, extract data improperly or circumvent security measures are prohibited.
Users are responsible for checking the quality, lawfulness and relevance of the information and documents they upload.
6Intellectual property
DJIB-TECHNO SARL retains all intellectual property rights in SMI Pilot, including the platform, interface, software, documentation and trademarks.
Customers retain full ownership of the data, content and documents they upload. They grant only the technical rights strictly necessary to host, process and return them as part of the service.
7Service availability and no guarantee of results
DJIB-TECHNO SARL uses reasonable efforts to maintain service availability and security. Interruptions may nevertheless occur for maintenance, updates, incidents or external causes.
No compliance, audit or certification outcome is guaranteed. Users remain responsible for their decisions, controls and organisational compliance.
8Limitation of liability
To the extent permitted by applicable law, DJIB-TECHNO SARL is not liable for indirect damage, loss of business, user-caused data loss, or decisions made solely on the basis of the service.
Any liability of the publisher is limited to direct, foreseeable and proven loss. This limitation does not apply where prohibited by law.
9Termination
Users may cancel their subscription through the available account management options or through Paddle. Cancellation takes effect at the end of the current paid period unless mandatory law provides otherwise.
DJIB-TECHNO SARL may suspend or terminate access for a material breach of these terms, with notice where circumstances allow.
10Governing law and disputes
These terms are governed by the laws of Djibouti. The parties will first seek an amicable resolution. Failing that, the competent courts of the Republic of Djibouti will have jurisdiction, subject to mandatory rules.
11Changes to these terms
DJIB-TECHNO SARL may amend these terms to reflect legal, technical or functional developments. Users will be informed of material changes before they take effect. The date at the top identifies the applicable version.
